Why Do Your Own Divorce

By Steven Gilmore | Jan 22, 2010

I cannot believe the number of divorces in our courts. More and more people decide to throw in the towel in their relationship.

Ever since it became more acceptable to get divorced, the rates started climbing. This can be good; there’s no point to couples remaining miserable.

Family law is a growing legal area as a result. However, not everyone hires a divorce lawyer. Sometimes it’s not necessary.

It’s not necessary for divorcing folks to automatically hire expensive lawyers. They can try working it out without counsel.

1. Spouses can try to hammer out terms on their own.

If you work it out at this stage, you’ll save tons of money and heartache. Just be sure to do up some form of agreement so there’s mutual understanding.

2. Mediators: the best one can hope for other than reconciliation is a negotiated resolution. This can be achieved by hiring a divorce mediator.

The mediation ends with an agreement drawn up for signing so everyone understands the terms and there’s a record of the agreed terms.

3. Each party hires attorneys but continue with the peaceful resolution method – which is to keep the lines of communication open between attorneys.

4. The spouses decide to hire an arbitrator knowledgeable about family law. The arbitrator hears the case and decides the issues.

Number 4 is a good option because it’s fast and won’t drain all the money. It can be done with attorneys or without attorneys.

5. Still no resolution? Put on the trial gloves and go let a court decide. When this happens you no longer have any control in the outcome.

As you can see there are many opportunities to get a divorce without an attorney. That said, if you’re unclear about your rights or you aren’t comfortable with how negotiations are going, visit a lawyer and get an opinion as to your rights.

Remember, you can, and should at any stage get independent legal advice about your rights. This is a simple legal consult where you get advice. It’s not a commitment to a full out legal battle.
